IMI Terms and Conditions

You are requested to read carefully the Conditions of car parking and to follow the procedures recommended in the Conditions which are for your benefit. Should you wish to make a complaint you are requested to follow the complaints procedure set out in condition number 7 below which will ensure that your complaint is brought promptly to the attention of the management.

This is a legal document which contains contractual provisions. Your Statutory Rights are not affected.

THE CUSTOMER MUST RETAIN THE RETURN INSTRUCTIONS/NUMBERED RECEIPT FOR THEIR VEHICLE IN A SAFE PLACE TO PRESENT TO IMI PARKING LTD ON THEIR RETURN, TO COLLECT THEIR VEHICLE.

DEFINITIONS

In this Agreement the following words shall have the following meanings:

'IMI PARKING DRIVER' means a driver employed (whether directly or via an agent) for the purposes of meeting customers and driving their vehicles to and from the airport and the car park.

'Vehicle' means a vehicle which is received by IMI PARKING LTD from the customer and shall include a car, transit van, truck, and other mechanical device on wheels or tracks, its equipment and accessories.

'Parking Period' means the period commencing when the keys to the vehicle are delivered to IMI PARKING LTD (or, if later, the last time that the Customer returns to the vehicle) and terminating at the time when the keys to the vehicle are handed back to the Customer (or, if earlier, when the Customer retakes possession of the vehicle).

1. BOOKINGS

1.1 Bookings through our website are deemed to be made when validated by the issue of an IMI PARKING LTD booking reference number.

1.2 Bookings made by telephone are deemed to be made when confirmed by IMI PARKING LTDS telesales operator.

1.3 Bookings made by post are deemed to be made when written confirmation is sent by IMI PARKING LTD.

1.4 All services are subject to availability.

1.5 A booking confirmation does not entitle the customer to any specified parking space or to priority over any other customer.

1.6 IMI PARKING LTD reserve the right not to accept or fulfil a booking.


2. PAYMENT

2.1 Payment for a booking made by telephone or on our website can only be made using Visa credit/debit/delta/electron, Master card credit/debit, Maestro, Solo.

2.2 If payment by card is declined or if a payment cheque is returned un cleared, IMI PARKING LTD and the service provider reserve the right not to fulfil your booking.

2.3 All prices are quoted in pounds Sterling including VAT.

2.4 When a booking is made using an overseas credit card the card issuer will debit your account in your local currency at the exchange rate applicable on the date of processing. A conversion charge may be applicable.


3. CANCELLATION

3.1 A booking may be cancelled in writing, via email, up to 48 hours prior to the date for which the service has been reserved.

3.2 Customers cancelling within 48 hours of the period for which the service is reserved shall be liable to pay the full price for the service booked (any abatement of the agreed price will be at IMI PARKING LTDS sole discretion).

3.3 For the purposes of this condition 3 the period for which the service is booked shall be deemed to commence at midnight on the day prior to the commencement date for the service booked.

3.4 Any customer wishing to curtail the length of stay for a service, once the service has commenced, will be liable to pay the fee for the whole of the service booked.


4. MEET & GREET AND PARKING

4.1 The customer is advised to allow for sufficient journey time to arrive at the airport terminal at the meeting time you will have designated to IMI PARKING LTD or your travel agent. The IMI PARKING LTD driver will wait for 15 minutes after that meeting time unless you have telephoned IMI PARKING LTD to advise of a further short delay .

4.2 The customer on handing over the vehicle to the IMI PARKING LTD driver must:

4.2.1 securely close all windows of the vehicle; and

4.2.2 remove all personal property from the vehicle

4.2.3 hand to the IMI PARKING LTD driver the ignition keys to the vehicle.

4.3 The IMI PARKING LTD driver will be authorised by the customer to have the right to drive or otherwise take the vehicle on the public highway. IMI PARKING LTD drivers are fully insured for this purpose.

4.3 The vehicle will be parked at the customer's risk and IMI PARKING LTDS liability is to take reasonable care of the customer's vehicle for the parking period .

4.4 The customer licences IMI PARKING LTD to bring and keep the vehicle on an IMI PARKING LTD car park and to move the vehicle to an alternative IMI PARKING LTD car park in the event of an accident or an emergency or to avoid an obstruction.

4.5 The customer must telephone IMI PARKING LTD on 0751 273 4617 at the time that they have collected their luggage and require their vehicle to be brought to the relevant terminal by the IMI PARKING LTD driver.

4.6 THE CUSTOMER SHALL INSPECT THEIR VEHICLE AT THE END OF THE PARKING PEROID AND REPORT ANY LOSS OR DAMAGE TO IMI PARKING LTD BEFORE DRIVING THE VEHICLE AWAY FROM IMI PARKING LIMITED CARE

4.7 IMI PARKING LTD will accept liability only when and to the extent that the same is caused by the negligence, wilful act or default or breach of statutory duty of IMI PARKING LTD its servants or agents for:

4.7.1 any damage to the paintwork or bodywork of the vehicle;

4.7.2 any defect to the vehicle which renders it un-driveable. In such circumstances IMI PARKING LTD will provide the Customer with a replacement vehicle, NOT NECESSARILY LIKE FOR LIKE.

4.8 In the event that IMI PARKING LTD accepts liability for a defect to the vehicle that remains driveable IMI PARKING LTD will arrange for one of it's pre-approved repairers to contact the customer direct to carry out the necessary repairs.

4.9 Any customer wishing to reclaim his vehicle prior to expiry of the agreed parking period will be liable to pay the parking fee for the whole of the agreed parking period.

4.10 Neither the customer nor any other person shall have the right to remove the vehicle or any other personal items left therein prior to payment in full of:

4.10.1 the parking fee for the parking period; and

4.10.2 any fuel purchased by IMI PARKING LTD for the vehicle; and

4.10.3 any recovery fees paid by IMI PARKING LTD in the event of a breakdown or mechanical failure of the vehicle.

4.11 It is the duty of the customer to ensure that the vehicle is in a proper roadworthy condition prior to leaving IMI PARKING LTDS premises and entering onto the public highway.

4.12 A customer must produce the numbered receipt provided by IMI PARKING LTD when reclaiming the vehicle. In the event that a receipt is lost IMI PARKING LTD shall be entitled to require proof of the customer's identity.

4.13 IMI PARKING LTD shall not be obliged to release the vehicle to a third party without the written authority of the customer.


5. CUSTOMER'S LIABILITY

5.1.1 The customer shall be liable for and indemnify IMI PARKING LTD in respect of any death, personal injury or damage caused by the customer or any person with the customer whilst on IMI PARKING LTDS premises or in anyway arising from a breach of the warranty in paragraph 5.1.2 below.

5.1.2 The customer warrants to IMI PARKING LTD that at the commencement of the parking period, the customer's vehicle is in a safe and roadworthy condition, has a current MOT certificate (if required by law) and that no dangerous toxic or illegal substances have been left within the vehicle.


6. EXCLUSION OF LIABILITY

6.1 IMI PARKING LTD does not accept any responsibility or liability for any theft, loss or damage to:

6.1.1 any personal property or personal items left within the vehicle whilst on IMI PARKING LTDS premises (whether or not during the Parking Period) or;

6.1.2 for any personal property (including travelling luggage) of the customer or any person travelling with the customer either when on IMI PARKING LTDS premises or whilst travelling between IMI PARKING LTDS premises and the airport.

6.2 IMI PARKING LTD does not accept any responsibility or liability for any damage to the windscreen or any other glass in the vehicle.

6.3 IMI PARKING LTD does not accept any responsibility or liability for damaged or punctured tyres.

6.4 IMI PARKING LTD does not accept any responsibility for any loss in the event that the customer's return instructions/numbered receipt for the vehicle is either lost or stolen which is subsequently presented to IMI PARKING LTD by a third party who uses it to fraudulently to take delivery of the customer's vehicle.


7. COMPLAINTS PROCEDURE

7.1 Nothing in this procedure restricts the customers right to pursue remedies through the court.

7.2 IMI PARKING LTD will acknowledge the customer's complaint in writing within 5 working days.

7.3 Subject to receiving the customer's co-operation in supplying any additional information which is required in relation to the complaint and (if required) the vehicle being made available for inspection IMI PARKING LTD will deal promptly with the complaint.

7.4 A complaint will initially be dealt with by IMI PARKING LTDS Customer Services Department.

7.5 IMI PARKING LTDS Customer Services Department will endeavour to give a written decision in respect of the complaint within 30 days of receiving the same. This period may need to be extended in the event of any delay in the customer supplying further information which is required or there being a delay in the vehicle being made available for inspection.

7.6 In the event of a complaint relating to alleged damage to a vehicle the customer will make the vehicle available for inspection by IMI PARKING LTD prior to any repairs being carried out thereto.

7.7 The Customer should send all written complaints to IMI PARKING LTDS Customer Services Department, and trading address Suites 1&2 Stanley House, Kelvin Way, Crawley, RH10 9SE


8. MISCELLANEOUS

The paragraph headings do not form part of these conditions and shall not be taken into account in the construction or interpretation thereof.


9. JURISDICTION

The contract between IMI PARKING LTD and the customer and any person travelling with the customer shall be governed by the laws of England and Wales and these conditions shall be construed in accordance with the laws of England and Wales and the parties hereby consent to the exclusive jurisdiction of the Courts of England and Wales
